YoYo blinds Terms & Conditions

In these terms and conditions .. "Contract" means Our contract with You on the terms of these Terms & Conditions. "Goods" means the blinds or other products manufactured or supplied by Us which are the subject of Your Order. "Order" means the order for Goods that you send to Us via the Website. "Price" means the price payable for the Goods as advertised on the Website at the time of Your Order. "You" and "Your" means the person ordering Goods from Us. "Yoyo Blinds " or "We" or "Us" or "Our" means Yoyo Blinds Limited of 36-38 Warren Road, Woodingdean, Brighton BN2 6BA. "Website" means www.yoyo-blinds.com

1. Our Contract

1.1 The Contract will only arise when (a) We have notified You of acceptance of Your Order by e-mail to the e-mail address as stated by You when making your Order, and (b) We have received payment for the Goods in full from You.


1.2 The Contract shall be on these Terms & Conditions to the exclusion of all other terms and conditions (including any terms or conditions which You may seek to apply) and the Contract will only be varied if we agree in writing to a variation.


1.3 Unless We specifically agree otherwise in writing, no Order can be placed by persons located or resident outside of the United Kingdom, nor for the delivery of Goods to an address outside the United Kingdom.



1.4 You are responsible for ensuring that your Order is accurate.




2. Price

2.1 The Price which you are to pay to Us will be as shown on the order confirmation page of Our website at the time of Your Order. The price will include VAT if that is shown on the confirmation page.




2.2 In addition to the Price, a delivery charge will be payable. The proposed delivery charge will be shown when you place the Order. However, we reserve the right to change the delivery charge which is payable, and if we change it we will ask You to confirm that You wish to proceed with Your order.



2.3 We will debit the price, plus any delivery charge, from Your debit or credit card when We receive Your Order or as soon as reasonably practicable thereafter. If more than one item is ordered We may deliver the Goods in instalments but, if We do, We will not charge more than one delivery fee.



3. Your Right to Cancel

3.1 Subject to the other provisions of this clause 3 and of clauses 6.2 and 6.3, You may cancel Your Order at any time within 7 days after you receive the Goods. To cancel Your Order You must notify Us by e-mail at info@yoyo-blinds.com with Your Order number or call us on 0845 2416898 with Your Order number.


3.2 Once Your Order has been placed with Us, You cannot cancel or change Your Order if the Goods are non-standard or are to be custom-made to Your measurements, or to any other requirements or specifications stated in Your Order.


3.3 If You receive the Goods before You cancel Your Order under clause 3.1, or if the Goods have already been despatched to you, Your right to cancel and to have the Price refunded to You is strictly subject to Your returning the Goods to Us in the same condition as when We sent them to You.


3.4 Subject to the provisions of this clause 3, we will refund the Price to You following cancellation of Your Order.

4. Cancellation by Us


4.1 We shall have the right to cancel Your Order if:

4.1.1 For any reason we are unable to fulfil Your Order;

4.1.2 Any Goods included in Your Order are listed on the Website at an incorrect price.


4.2 We will notify You by e-mail if We cancel Your Order and We will then as soon as possible re-credit to You any sum deducted by Us from Your debit or credit card. That will be Our maximum liability to You.



5. Non-Availability


If the Goods or the fabric You order are unavailable We will notify You as soon as possible and suggest a suitable replacement. Until a replacement is agreed, the Order will be subject to cancellation, and if no replacement is agreed, it will be cancelled.



6. Product Descriptions and Measurement


6.1 We will provide free samples of fabrics on request.


6.2 The descriptions and illustrations of products on the Website are intended for guidance only. We do not warrant the accuracy of any such descriptions and illustrations. We will endeavour to ensure that the Goods match samples or descriptions, but You will not be entitled to reject Goods where variation in colour or pattern is minor only.


6.3 You will be solely responsible for the accuracy of any measurements which You include in Your Order. We cannot accept the return of the Goods by reason of the measurements provided being incorrect. Manufactured sizes may vary by up to 4mm and shall not entitle you to reject the goods.

7. Delivery


7.1 Unless a later date is agreed with You, We will deliver the Goods to the address stated in the Order within 30 days after acceptance of Your Order. Unless We specifically agree, We will not be bound by any delivery date which You specify. Time for delivery will not be of the essence.


7.2 Risk in the Goods will pass to You when they have been delivered to You. If You return Goods to Us, risk in the Goods will not pass to Us until We actually receive the Goods.


8. Defective Goods


8.1 We warrant that all Goods sold to You will be free from defects in material and workmanship for a period of 12 months from delivery to You.


8.2 If Goods are defective on delivery or a defect arises within the following 12 months, You should contact Us by e-mail at info@yoyoblinds.co.uk or call us on 0845 2416898 (in each case quoting Your Order number) and provide details of the defects. If it appears that the Goods are defective We will arrange:


8.2.1 for a courier to collect the defective Goods from You in order to repair the Goods and return the repaired Goods to You, free of charge; or


8.2.2 for a courier to collect the defective Goods from You and simultaneously deliver replacement Goods of similar quality and specification, free of charge.


8.3 We shall have no liability under this clause 8:

8.3.1 if You have failed to pay the Price and the delivery charge in full on or before delivery; or

8.3.2 if we are not satisfied that the Goods are defective; or

8.3.3 if the Goods have been modified, misused or damaged.


8.4 Where the warranty under this clause 8 does not apply, We will be entitled to charge You on a time and materials basis in respect of any repairs and collection and return of the Goods which We agree to carry out at Your request. We shall be entitled to debit such charge on the debit or credit card which You used to order the Goods provided We notify You of the amount of such charges before carrying out the repair.


8.5 We will not be liable for any indirect or consequential loss or damage or loss of profits.


8.6 Your rights under this clause 8 do not in any way seek to limit Our liability for death or personal injury resulting from Our negligence, nor any statutory rights which may apply if You are a consumer. Subject to this, all other warranties, conditions and terms whether statutory, express, implied or otherwise are excluded to fullest extent allowed by law


8.7 We make no representation and accept no liability in respect of the export or import of the Goods.

9. Use of Credit and Debit Cards


By placing an Order You authorise Us at Our discretion to carry out any credit reference or other enquiry upon Your financial status and You agree to provide such written authorisations which may be required for the purposes of such enquiry. Without such authorisation We will be unable to process Your order.

10. Entire Agreement


These terms & conditions and Your Order represent the entire agreement between You and Us. No statement, description, or recommendation contained in the Website or any catalogue, price list, advertisement, or other communication shall be interpreted so as to enlarge, vary or override in any way any of these terms & conditions.

11. Events Beyond Our Control


We shall have no liability to You for any failure to deliver Goods You have ordered or for any delay in doing so or for any change of the specified delivery date or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond Our reasonable control including, without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

12. Invalidity


If any part of these terms & conditions is unenforceable (including any provision in which We exclude our liability to You) the enforceability of any other part of these terms & conditions will not be affected.

13. Privacy


You acknowledge and agree to be bound by the terms of Our privacy policy as shown in the Website.

14. Third Party Rights


A person who is not a party to the Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.

15. Governing Law


The Contract is subject to English law and the exclusive jurisdiction of the English courts.
